Introduction
Welcome to LearnBA, an online learning platform provided by The Business Analysis Office. This Terms of Service agreement (“Agreement”) is a legal agreement between you (“you,” “your,” or “user”) and The Business Analysis Office (“LearnBA,” “we,” “us,” or “our”). By accessing or using our website, learnba.io (“Website”) and/or our online learning platform, LearnBA (“Platform”), you agree to be bound by this Agreement.
Overview and General Terms
LearnBA is an online learning platform that provides business analysis courses and training programs (“Courses”). Our Platform is designed to help you gain new knowledge and skills in business analysis, and we strive to make it a great experience for all users. To use LearnBA, you must be at least 18 years old and agree to the terms set forth in this Agreement.
Course Access and Fees
When you enrol in a Course, you will be given access to the Course content for the duration of the course period. You may be required to pay a fee to enroll in a Course, and these fees are non-refundable. We reserve the right to change the fees for our Courses at any time, but any changes will not affect the fees for Courses for which you have already enrolled.
User Content and Conduct
You are solely responsible for any content, including but not limited to, text, images, videos, and other materials (“User Content”) that you upload or post on our Platform. You represent and warrant that you have all necessary rights to use and upload such User Content and that such User Content does not infringe upon any third-party rights.
You agree not to use our Platform to:
- Upload, post, or otherwise transmit any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable;
- Engage in any conduct that would violate any applicable law or regulation;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Attempt to interfere with our Platform’s functionality or to access our Platform in any way that is not authorized by us.
Intellectual Property
All content on our Platform, including but not limited to text, images, graphics, videos, and software, is owned by The Business Analysis Office and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any content on our Platform without our prior written consent.
Disclaimer of Warranties
Our Platform and Courses are provided “as is” and “as available.” We make no warranties, express or implied, as to the accuracy, completeness, or reliability of any content available on our Platform. We do not warrant that our Platform or Courses will meet your requirements or expectations or that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of Liability
In no event shall The Business Analysis Office or its affiliates, directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our Platform or Courses, whether based on contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold The Business Analysis Office, its affiliates, directors, officers, employees, and agents harmless from any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of our Platform or Courses, your User Content, or your breach of this Agreement.
Termination
We reserve the right to terminate your access to our Platform or Courses at any time and for any reason without notice to you. Upon termination, you must immediately cease all use of our Platform and Courses, and any provisions of this Agreement that should, by their nature, survive termination shall continue to do so.
Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with this Agreement shall be resolved through binding arbitration in accordance with the Arbitration Act 1996. The arbitration shall take place in London, UK, and the language of the arbitration shall be English. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notices
All notices required or permitted to be given under this Agreement shall be in writing and shall be deemed to have been duly given when delivered in person or by email to the recipient’s last known email address.
Assignment
You may not assign or transfer this Agreement or any of your rights or obligations hereunder without our prior written consent. We may assign or transfer this Agreement, in whole or in part, without your consent.
Waiver
The failure of The Business Analysis Office to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
Headings
The headings in this Agreement are for convenience only and shall not affect the interpretation of this Agreement.
Force Majeure
We shall not be liable for any failure to perform our obligations under this Agreement if such failure is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, natural disasters, or technical failures.
Language
This Agreement is drafted in the English language. If we provide a translation of this Agreement, the English version shall govern.
Changes to the Agreement
We reserve the right to modify this Agreement at any time and without prior notice to you. You are responsible for reviewing this Agreement periodically to ensure that you are aware of any changes. Your continued use of our Platform or Courses after any modifications to this Agreement will constitute your acceptance of such modifications.
Entire Agreement and Severability
This Agreement constitutes the entire agreement between you and The Business Analysis Office with respect to the use of our Platform and Courses and supersedes all prior or contemporaneous agreements or understandings, whether written or oral. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By using LearnBA, you agree to be bound by the terms set forth in this Agreement. If you do not agree to these terms, do not use our Platform or Courses.
By accepting these terms, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are accepting these terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to this Agreement.
